Terms of Service

By joining the waitlist, creating an account, or using Viralway, you agree to these Terms of Service. If you are using the service on behalf of a company, you confirm you have authority to bind that company to these terms.

Viralway produces short form content for mobile apps from briefs and assets you provide. Features may change, be added, or be removed as the product evolves, including during the waitlist and early-access period.

You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You must be at least 15 years old to use the service. If you are under 18, or under the age of majority where you live, you need a parent or guardian's permission to use the service and to buy a paid plan, and they agree to these terms on your behalf.

You keep ownership of the briefs, assets, and other materials you upload. You grant us a limited license to process them solely to provide the service, for example to produce your videos.

You are responsible for making sure your content doesn't infringe anyone's rights and that you have permission to use any brand assets, footage, or music you upload.

Subject to your plan and these terms, you own the ad creatives produced for you and may use them in your marketing campaigns. You are responsible for ensuring your use of those ads complies with the policies of the platforms where you run them and with applicable advertising laws.

You may not use the service to create content that is unlawful, deceptive, infringing, or harmful. This includes ads that misrepresent a product, impersonate real people without consent, or target protected groups improperly. We may suspend or terminate accounts that violate these rules.

Paid plans are billed as described at checkout. Fees are non-refundable except where required by law. We may change pricing with reasonable advance notice; changes apply from your next billing cycle.

The service is provided "as is" and "as available." We do not guarantee that the ads will achieve any particular performance, that the service will be uninterrupted, or that it will be error-free.

To the maximum extent permitted by law, Viralway will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability under these terms is limited to the amount you paid us in the twelve months before the claim arose.

You can stop using the service and delete your account at any time. We may suspend or terminate access if you breach these terms. Sections that by their nature should survive termination, such as ownership, disclaimers, and limitation of liability, will survive.

We may update these terms from time to time. If we make material changes, we will notify you by email or with a notice on the site. Continuing to use the service after changes take effect means you accept the updated terms.
